Welcome to Be You. By downloading, accessing, or using the Be You app or related services, you agree to these Terms and Conditions. If you do not agree, please do not use our services.

1. Description of service

Be You is a platform that connects people and organizations who wish to donate surplus food with shelters, food banks, and community centers. We facilitate the listing of donations, matching with recipients, and communication related to pickups. We do not prepare, handle, or deliver food ourselves; donors and recipients are responsible for their own compliance with food safety and local laws.

2. Eligibility

You must be at least 13 years old and able to form a binding contract to use Be You. If you are under 18, you should use the app with the consent of a parent or guardian. By using Be You, you represent that you meet these requirements and that all information you provide is accurate.

3. Account and conduct

You are responsible for maintaining the confidentiality of your account and for all activity under your account. You agree to:

Provide accurate and complete information when registering and when creating donations.
Use the app only for lawful purposes and in line with these Terms.
Not misuse the app (e.g., spam, harassment, false or misleading listings, or violation of others’ rights).
Comply with all applicable laws, including those related to food safety and donation.

We may suspend or terminate your account if you breach these Terms or for other reasons we deem necessary to protect the community and our services.

4. Donations and food safety

Donors are solely responsible for the quality, safety, and legality of donated food. You must ensure that donated food is fit for consumption and handled in accordance with applicable health and safety rules. Be You does not inspect, certify, or guarantee any donation. Recipients use donations at their own risk. We are not liable for any illness, loss, or damage arising from donated food.

5. Content and intellectual property

You retain ownership of content you post (e.g., photos, descriptions). By posting, you grant Be You a non-exclusive, royalty-free license to use, display, and distribute that content in connection with the service. The Be You name, logo, and app design are our intellectual property; you may not use them without our prior written permission.

6. Disclaimers

Be You is provided “as is.” We do not guarantee uninterrupted, error-free, or secure operation. We are not responsible for the conduct of users, the quality of donated food, or the actions of shelters or other partners. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

7. Limitation of liability

To the maximum extent permitted by law, Be You and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the app or these Terms. Our total liability for any claims related to the service shall not exceed the amount you paid to us in the twelve months before the claim (or one hundred U.S. dollars if you paid nothing).

8. Indemnification

You agree to indemnify and hold harmless Be You and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the service, your content, your donations, or your violation of these Terms or any law.

9. Changes to terms and service

We may modify these Terms or the service at any time. We will notify you of material changes via the app or by email where appropriate. Continued use after changes constitutes acceptance. If you do not agree, you must stop using the app.

10. General

These Terms constitute the entire agreement between you and Be You regarding the service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce any right does not waive that right. These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles.
